tervix respects the intellectual property rights of others and expects users of our services to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act and other applicable intellectual property laws.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our services, please notify our designated copyright agent as specified below.

Required Information for DMCA Notice

For your complaint to be valid under the DMCA, you must provide the following information in writing:

  • An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner
  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to permit us to locate the material
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Counter-Notification Procedure

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our designated copyright agent:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, tervix has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our services and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Response and Action Timeline

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material that it has been removed or disabled
  • Provide the user with a copy of the DMCA notice
  • Take reasonable steps to notify the user of the counter-notification procedure

If we receive a valid counter-notification, we may restore the removed material or cease disabling access to it in not less than ten business days but not more than fourteen business days following receipt of the counter-notification, unless our designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity.

False Claims

Please note that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We may seek damages from any party that submits a notification or counter-notification in violation of the law.
